Quorum and majorities at the owners' meeting in Croatia

Short answer

A management decision is adopted when a majority of more than half of the co-owners, counted by share, votes in favour of it. The act has no separate quorum rule: a decision is carried on the required share of the whole building, or it is not carried.

What this means in practice

The act names three majorities, all counted by share: more than 50 per cent, more than two thirds, and a qualified majority of more than 80 per cent of the total value area or of the co-ownership shares entered in the land register. A qualified majority is needed for investment maintenance, for converting common parts, for adding storeys, for letting common parts for more than a year and for mortgaging the building. Electing a representative who is not a co-owner or a close relative living in the building needs two thirds. The manager must file the decisions in the register of co-owners' communities.

General information, not legal advice. Check with a lawyer in Croatia before relying on it, and read your building's own documents: they can change how a rule applies.

Where Unitify fits

Unitify records how each owner votes and shows participation (units voted out of the units invited) and the result. Whether a meeting has a quorum and a decision passes is decided by the law above and your own rules; the record helps you check it.
