Quorum and majorities at the owners' meeting in Vietnam

Short answer

The annual conference of the building is held once a year when at least 30 per cent of the representatives of owners of handed-over apartments attend, or fewer if the owners agreed a lower figure at the first conference. Decisions are adopted by the majority of the votes of the owners and users who attend.

What the law says

Original wording of the law (Vietnamese). The summary and the notes around it are ours.

What this means in practice

The 30 per cent rises to 50 per cent when the annual conference also decides on electing or dismissing the management board or renewing the operating contract; an extraordinary conference needs 50 per cent, or 75 per cent of those who petitioned for it. Attendance is counted in people (representatives of owners), while voting is weighted by area: one square metre of privately owned area is one vote.

General information, not legal advice. Check with a lawyer in Vietnam before relying on it, and read your building's own documents: they can change how a rule applies.

Where Unitify fits

Unitify records how each owner votes and shows participation (units voted out of the units invited) and the result. Whether a meeting has a quorum and a decision passes is decided by the law above and your own rules; the record helps you check it.
