Remote and electronic voting by owners in Brazil

Short answer

Yes, as long as the condominium's convention does not forbid it. Convening, holding and deciding any kind of assembly may be done electronically, provided the owners keep their rights to speak, debate and vote. The notice must say that the assembly will be electronic and give instructions on access, speaking and how votes are collected.

What the law says

Original wording of the law (Portuguese). The summary and the notes around it are ours.

1.354-A, caput e § 1º · Official text

Do instrumento de convocação deverá constar que a assembleia será realizada por meio eletrônico, bem como as instruções sobre acesso, manifestação e forma de coleta de votos dos condôminos.

What this means in practice

A hybrid format, with owners present in person and online at the same time, is allowed. The minutes are drawn up only after all votes are added up and announced, and are also electronic. The administration is not liable for owners' equipment or connection problems. Complementary rules can go into the internal regulation, approved by a simple majority of those present at an assembly called for that purpose. The Code names no video platform and requires no specific electronic signature for the minutes.

General information, not legal advice. Check with a lawyer in Brazil before relying on it, and read your building's own documents: they can change how a rule applies.

Where Unitify fits

Unitify records votes and keeps the result. It does not run video meetings of its own and does not by itself satisfy an identification or signature rule of your law. Whether a vote taken this way counts depends on the law above and on your own rules.
