Remote and electronic voting by owners in Germany

Short answer

Yes. Owners can resolve, by at least three quarters of the votes cast, that assemblies take place for up to three years without owners and manager being physically present at one venue (a virtual assembly). It must be comparable to an in-person assembly in participation and in the exercise of rights. Letting owners join an in-person assembly electronically (a hybrid assembly) needs only a simple resolution.

Die Wohnungseigentümer können mit mindestens drei Vierteln der abgegebenen Stimmen beschließen, dass die Versammlung innerhalb eines Zeitraums von längstens drei Jahren ab Beschlussfassung ohne physische Präsenz der Wohnungseigentümer und des Verwalters an einem Versammlungsort stattfindet oder stattfinden kann (virtuelle Wohnungseigentümerversammlung). Die virtuelle Wohnungseigentümerversammlung muss hinsichtlich der Teilnahme und Rechteausübung mit einer Präsenzversammlung vergleichbar sein.

What this means in practice

Transition rule: if a virtual-assembly resolution is passed before 1 January 2028, at least one in-person assembly a year must still be held through 2028, unless the owners waive it unanimously; a breach does not make the resolutions void or voidable. The amending law of 10 October 2024 came into force on 17 October 2024.
