Remote and electronic voting by owners in Florida

Short answer

A Florida condominium association may conduct elections and other unit owner votes through an Internet-based online voting system if the unit owner consents, electronically or in writing, and if the statute's conditions are met. The association must give each owner a way to authenticate their identity, and the system must authenticate each vote and send the voter a receipt; for board elections it must also separate identifying information from the ballot permanently.

What this means in practice

A unit owner voting electronically counts as present for the quorum. The board adopts online voting by resolution, and if 25 percent of the voting interests petition, the board must meet within 21 days to consider adopting it. The association must give each owner a way to confirm at least 14 days before the voting deadline that their device can communicate with the system. If the association has not adopted such a system, it must designate an e-mail address for ballots, with a prescribed warning that e-mailing a ballot waives its secrecy. The homeowners' association statute (chapter 720) differs; this page covers condominiums.

Where Unitify fits

Unitify records votes and keeps the result. It does not run video meetings of its own and does not by itself satisfy an identification or signature rule of your law. Whether a vote taken this way counts depends on the law above and on your own rules.
