Reserve and repair fund rules in Slovenia
If a property has more than two owners and more than eight separate units, the owners must set up a reserve fund (rezervni sklad) to cover future costs of regular management. The fund is the owners' joint property, and the manager keeps it separately on a special account.
What the law says
Če ima nepremičnina več kot dva etažna lastnika in več kot osem posameznih delov, morajo etažni lastniki ustanoviti rezervni sklad za kritje bodočih stroškov rednega upravljanja. (2) Sredstva rezervnega sklada so skupno premoženje etažnih lastnikov. Sredstva vodi upravnik ločeno na posebnem računu.Last verified:
What this means in practice
A regulation sets the criteria for each owner's contribution and the minimum amount. The fund can be used only for maintenance, necessary improvements and repaying loans taken for them, and an owner cannot ask for payments back. If an owner does not pay, the manager must call them to pay in writing, and that call counts as an authentic document for enforcement. Owners may agree a higher monthly payment than the regulation requires.
Where Unitify fits
Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
