Reserve and repair fund rules in Italy
The Civil Code does not require a general reserve fund. When the assembly decides extraordinary maintenance or innovations, it must set up a special fund equal to the amount of the works. If the works are paid in instalments as they progress, the fund may be built for each payment due.
What the law says
What this means in practice
Terms such as "fondo cassa" are used in practice but not by the Code, which sets no fund of that name and no size for one. How the cost is shared among owners follows the general expense rules in art. 1123 and the following articles. The yearly accounts (rendiconto) must show available funds and reserves. The administrator may not order extraordinary works unless they are urgent, and must then report to the first assembly.
Where Unitify fits
Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
