Reserve and repair fund rules in Florida

Short answer

A residential condominium association must have a structural integrity reserve study completed at least every 10 years for each building three habitable stories or higher. For budgets adopted on or after 31 December 2024, unit-owner-controlled associations that must obtain the study may not vote to provide no reserves or less reserves for the items listed in the study, and may not use those reserve funds for any other purpose.

Also relevant

For a budget adopted on or after December 31, 2024, the members of a unit-owner-controlled association that must obtain a structural integrity reserve study may not determine to provide no reserves or less reserves than required by this subsection for items listed in paragraph (g)
Provision: Fla. Stat. § 718.112(2)(f)2.b. · Official text

What this means in practice

The study covers the roof, structure, fireproofing, plumbing, electrical systems, waterproofing and exterior painting, windows and exterior doors, and any other item whose deferred maintenance or replacement cost exceeds $25,000. The reserve for those items must follow the findings of the most recent study. Unit-owner-controlled associations that existed on 1 July 2022 were required to complete the study by 31 December 2025; where a milestone inspection is also required, the association may complete the study together with it, but in no event after 31 December 2026. A 2025 amendment lets the board, with the approval of a majority of the total voting interests, pause or reduce those reserve contributions for no more than two consecutive budgets adopted on or before 31 December 2028, to fund repairs recommended by a milestone inspection completed in the previous two calendar years; developer-controlled associations are excluded. An association operating a multicondominium may have an alternative funding method approved by the division. This page covers condominiums; reserves outside Florida are not covered.

Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
