Reserve and repair fund rules in Colombia
The legal entity of every complex must set up a fund for unforeseen obligations or expenses (fondo de imprevistos), built and increased with a surcharge of at least 1 per cent on the annual budget of common expenses and with the other income the assembly considers appropriate. The assembly may suspend collection when the fund reaches 50 per cent of that year's ordinary budget.
What the law says
Last verified:
Also relevant
What this means in practice
The administrator may use the resources with the assembly's prior approval where it applies and as the horizontal property regulation provides. Extra extraordinary assessments on top of the surcharge can be approved only when the fund is not enough. For social-interest housing buildings of five units or fewer, the fund is optional.
Where Unitify fits
Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
