Reserve and repair fund rules in Latvia
Owners make payments into the savings fund (uzkrājumu fonds), in proportion to their share of the common property, on the basis of a decision of the owners' community. The community also decides how the payments are made and how the money is used. When deciding, it assesses the documents that justify the activities and their costs.
What the law says
Dzīvokļa īpašnieks atbilstoši viņa dzīvokļa īpašumā ietilpstošās kopīpašuma domājamās daļas apmēram veic uz dzīvokļu īpašnieku kopības lēmuma pamata noteiktos naudas maksājumus uzkrājumu fondā šā panta pirmajā un otrajā daļā paredzēto dzīvojamās mājas pārvaldīšanas darbību veikšanai. Pieņemot minēto lēmumu, dzīvokļu īpašnieku kopība izvērtē dokumentus, kas pamato attiecīgo darbību veikšanu un to izmaksas. (2²) Šā panta 2.1 daļā minēto naudas maksājumu veikšanas un izmantošanas kārtību nosaka dzīvokļu īpašnieku kopība.Last verified:
What this means in practice
The sources checked found no statutory minimum contribution and no compulsory capital-repair contribution in this law: the fund exists on the owners' decision. The law does protect the money: the manager may not use the fund for its own losses or for another owner's arrears, and the amount saved is part of the house file in the Building Information System.
Where Unitify fits
Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
