Reserve and repair fund rules in Serbia

Short answer

The amount set aside for investment maintenance of the common parts is decided by the assembly and cannot be lower than the minimum in the act that the local self-government passes on investment maintenance of buildings. That amount is the building's reserve fund.

What the law says

Original wording of the law (Serbian, Cyrillic). The summary and the notes around it are ours.

What this means in practice

The minimum is set by the city or municipality, not nationally: the local self-government passes separate acts for the minimum current-maintenance amount, for the fee in a forced professional-manager case and for the minimum investment-maintenance amount. The assembly's decision is entered in the minutes and an extract with the manager's certified signature is drawn up.

General information, not legal advice. Check with a lawyer in Serbia before relying on it, and read your building's own documents: they can change how a rule applies.

Where Unitify fits

Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
