Reserve and repair fund rules in Spain

Short answer

A reserve fund is mandatory in every community of owners. It must hold at least 10 per cent of the last ordinary budget, belongs to the community, and serves conservation, repair and rehabilitation works and the accessibility and energy-efficiency works named in the law. Owners contribute in proportion to their participation quota.

What the law says

Original wording of the law (Spanish). The summary and the notes around it are ours.

El fondo de reserva, cuya titularidad corresponde a todos los efectos a la comunidad, estará dotado con una cantidad que en ningún caso podrá ser inferior al 10 por ciento de su último presupuesto ordinario.

What this means in practice

The fund may also pay for an insurance contract or a permanent maintenance contract for the building. The minimum was 5 per cent until the 2019 reform raised it to 10 per cent; a page that still says 5 per cent for the state law is out of date. The law says nothing about a separate bank account or accounting entries for the fund. Catalonia has its own rule (at least 5 per cent of common expenses, separate account), not covered here.

General information, not legal advice. Check with a lawyer in Spain before relying on it, and read your building's own documents: they can change how a rule applies.

Where Unitify fits

Unitify keeps a balance per unit and records each contribution against the right unit. The size of the fund and what it may be spent on come from the law above and from the owners' decisions.
