Arrears: what happens when owners do not pay in Azerbaijan
An owner who evades paying, on time and in full, the costs of maintaining their own premises and the common property of the building is fined 100 to 150 per cent of the amount due under the Code of Administrative Offences. When ownership of the premises is transferred, the obligation to pay capital-repair costs passes to the new owner.
What the law says
Çoxmənzilli binanın sahə mülkiyyətçisi, o cümlədən müvafiq icra hakimiyyəti orqanının müəyyən etdiyi orqanın (qurumun) satmaq öhdəliyi ilə kirayəyə verdiyi yaşayış sahəsinin kirayəçisi tərəfindən ona məxsus olan sahənin saxlanması xərclərini, habelə mənzil qanunvericiliyinə uyğun olaraq çoxmənzilli binanın ümumi əmlakının saxlanması xərclərini vaxtında və tam məbləğdə çəkməkdən boyun qaçırılmasına görə- ödənilməli olan ödənişlərin məbləğinin yüz faizindən yüz əlli faizinədək məbləğdə cərimə edilir.Last verified:

The fine is a multiple of the debt, not a fixed sum. The Housing Code expressly gives an owners' association the right to sue for compulsory recovery, but gives no such right expressly to a managing organisation, which relies on its contract. The Housing Code puts no duty on the seller to tell the buyer about the debts.
