Questions a building manager in Azerbaijan asks
Do I need a license to manage a building in Azerbaijan?
No. Managing a multi-apartment building is not a licensed activity — a managing organization (idarəedici təşkilat) can be any legal person or sole trader. The Cabinet of Ministers sets the open-competition rules (Decision No. 128 of 2010), and municipalities run the open competition when owners choose no management form.
What happens if owners don't choose a management form?
The municipality convenes the owners' meeting at six months, and at twelve months runs an open competition for a managing organization — owners are then obliged to sign with the winner. The municipality does not become the manager itself.
When is the maintenance charge due each month?
Unless the management contract says otherwise, the charge for each month is payable by the 15th of the following month, against payment documents presented by the 5th — a billing calendar written into the Housing Code itself.
What happens if an owner doesn't pay?
An owners' association (MMMC) can sue for compulsory recovery of the mandatory payments and for the loss non-payment caused. Separately, evading payment on time and in full is an administrative offence — a fine of 100% to 150% of the amount due, imposed conditionally on a first offence.
Can owners vote electronically?
Not for a binding decision. The Housing Code has no electronic-voting provision — the absentee ballot is expressly a written decision delivered to the address named in the meeting notice.
