Arrears: what happens when owners do not pay in Spain

Short answer

Owners who are not up to date with all overdue debts to the community when the meeting starts, and have not challenged them in court or deposited the sum with a court or notary, may speak but cannot vote. The minutes record who has lost the vote, and their persons and quotas do not count toward the majorities. The meeting may also agree deterrent measures, such as interest above the legal rate or temporary loss of use of services or installations.

What the law says

Original wording of the law (Spanish). The summary and the notes around it are ours.

What this means in practice

Deterrent measures must not be abusive or disproportionate or affect habitability, cannot be retroactive, and may be written into the community's statutes. Debts to the community accrue interest from the day payment was due. The notice of the meeting must list the owners in arrears and warn of the loss of the vote. The legal interest rate is set outside this law and is not quoted here.

General information, not legal advice. Check with a lawyer in Spain before relying on it, and read your building's own documents: they can change how a rule applies.

Where Unitify fits

Unitify records the debt per unit, records payments and sends reminders. Interest, voting limits, liens and enforcement come from the law above and your own rules and are applied by people; Unitify records the debt and the payments.
