Arrears: what happens when owners do not pay in Mexico City
Owners or possessors in arrears lose their vote at the general assembly but always keep their voice, except in assemblies convened to change the constitutive deed, end the condominium regime or affect ownership of the property. In arrears means two or more unpaid cuotas to the maintenance and reserve funds, an unpaid extraordinary cuota, or an unpaid court or administrative award for damages to the condominium. Those in arrears do not count for the quorum and cannot be elected administrator or sit on the supervisory committee.
What the law says
Last verified:
What this means in practice
Late cuotas bear default interest at the legal rate fixed in the assembly or the internal rules, which the law caps at nine per cent a year. A settlement statement signed by the administrator and the chair of the supervisory committee, with the receipts and a certified copy of the minutes, is an enforceable title once two ordinary cuotas or one extraordinary cuota are unpaid. Before starting a procedure at the Procuraduría Social, the administrator must show a completed internal mediation. This page covers Mexico City only.
