Arrears: what happens when owners do not pay in Italy
To collect the contributions approved by the assembly, the administrator can obtain an immediately enforceable payment order (decreto ingiuntivo) without the assembly's authorisation. The administrator must give the details of defaulting owners to unpaid creditors who ask for them. After six months of arrears the administrator may suspend the defaulting owner from common services that can be enjoyed separately.
What the law says
Last verified:
What this means in practice
Suspension is a power, not a duty, and only for services that can be used separately. The article gives no basis for publishing debtors' names on a noticeboard or in the minutes. Another article (art. 1129) sets the administrator's own deadline to start enforced collection: six months from the end of the financial year in which the debt fell due, unless the assembly has expressly excused him. Creditors must pursue the defaulting owners before the owners who are up to date.
Where Unitify fits
Unitify records the debt per unit, records payments and sends reminders. Interest, voting limits, liens and enforcement come from the law above and your own rules and are applied by people; Unitify records the debt and the payments.
