One Housing Code, three management forms, one managing organisation per building (art. 141)

Multi-apartment buildings are governed by the Housing Code of the Republic of Azerbaijan, adopted 30 June 2009 and in force since 1 October 2009. Owners must choose one of three forms at a general meeting — direct management, an MMMC or specialised cooperative, or a managing organisation — and a building may have only one managing organisation. If owners choose nothing within a year, the municipality runs an open competition and owners must contract with the winner.

General meeting: over-50% quorum, no reduced repeat quorum, no electronic vote (arts. 43–47)

The owners' general meeting is the building's management body. Quorum is more than half of all votes, with no reduced quorum if a meeting fails and must be re-run. Most decisions pass on a majority present; reconstruction, land-use limits and giving common property into use need two-thirds of all votes. Absentee voting exists, but the Code has no electronic ballot — the written decision is delivered to the address named in the meeting notice.

The MMMC: a non-commercial legal person, one per building, with its own bank accounts (arts. 119–131)

An owners' association — mənzil mülkiyyətçiləri müştərək cəmiyyəti — is created by a general-meeting decision carried by more than half of all votes, and a building may have only one. It has its own bank accounts, a board and an audit commission; the board monitors timely payment by each participant and puts an annual estimate and financial report to the meeting. A reserve or repair fund may be created by the meeting, but no capital-repair contribution is mandatory.

A billing calendar written into the Code: invoice by the 5th, payment by the 15th (art. 137.1)

Unless the management contract says otherwise, each month's charge is payable by the 15th of the following month against payment documents presented by the 5th, and a rate change must be notified 30 days before the first bill that carries it. There is no requirement to open a separate bank account per building and no cashless-payment mandate.

Arrears: a court claim, and an administrative fine up to 150% of the debt on a repeat offence (art. 393-1.4)

An MMMC may sue in court for compulsory recovery of the mandatory payments and for the loss non-payment caused. Separately, the Code of Administrative Offences treats evading payment of maintenance costs on time and in full as an offence — a fine of 100% to 150% of the amount due, heard by the Ministry of Economy or the local executive authority, and imposed conditionally on a first offence.

Managing a building is not a licensed activity, and the Housing Code sets up no state platform

A managing organisation may be any legal person or sole trader, whatever its organisational-legal form — construction is licensed, managing the finished building is not. The Housing Code provides no electronic voting, no mandatory electronic reporting, no per-building bank account, and no state register of buildings, associations or managing organisations; records and charge calculations sit with the association or the managing organisation itself.

Questions developers and building managers ask

How should a developer approach smart-building technology in a new Azerbaijani complex?

Treat it as one platform decision, not a shopping list of hardware: access control, video intercoms, dispatching and a resident app should hand over to the building's management form already connected. Where the developer owns every unit before the first sale, it can set that management form alone and in writing (art. 45.7) — exactly the moment a platform decision gets made.

What is a managing organisation, and does it need a licence in Azerbaijan?

It's the idarəedici təşkilat — any legal person or sole trader that owners contract with to run the building, chosen at the owners' general meeting or, if owners choose nothing within a year, by an open municipal competition. Managing a building is not a licensed activity in Azerbaijan.

Does Azerbaijan's Housing Code let owners vote electronically?

No. The Housing Code contains no electronic-voting provision: an absentee ballot is expressly a written decision delivered to the address named in the meeting notice (art. 47.5). The only electronic system the Code mentions is document retrieval from the E-Government Information System for conversion and housing-registration paperwork — nothing about meetings, charges or reporting.

How does a video intercom with phone unlocking work?

The call goes to the resident's phone through the app instead of a panel inside the apartment. The resident sees the visitor on camera and unlocks the door remotely.

What does a smart building cost a developer in Azerbaijan, roughly?
