Questions a building manager in Kyrgyzstan asks
Which law governs owners' associations in Kyrgyzstan now?
The 1997 Law on Homeowners' Associations is no longer in force. Multi-apartment buildings are governed by the Housing Code of 9 July 2013 No. 117 (Chapter 4 — management of common property) and Law No. 122 of 9 July 2013 on associations of owners of residential and non-residential premises of multi-apartment buildings, which governs how the association itself works.
Do I need a licence to manage a building in Kyrgyzstan?
Managing a multi-apartment building in Kyrgyzstan is not a licensed activity, and there is no certification requirement and no state register of managers.
What happens if owners don't choose a management form?
Kyrgyz law provides no default. The mechanism that existed until 15 August 2023 was repealed by Law No. 182 and nothing replaced it — if the owners of a building never decide, nothing appoints a manager for them.
Is cashless settlement mandatory?
Since 15 August 2023 both an owners' association and a managing organisation must take mandatory payments and contributions into a bank account and keep income and expenditure cashless. From 1 January 2026 owners have had a statutory right to stop paying an association that does not settle cashlessly, and they resume paying when it does.
Can an owners' association vote electronically?
Absentee voting is available and is cast on a paper ballot sheet, every page of which is signed by the chairman of the board and stamped, with the results posted on the information board; the law provides no electronic ballot.
What happens if an owner doesn't pay?
An owners' association may set a late-payment penalty in its charter, but the law caps it at twenty per cent of the total debt. Arrears follow the apartment: on a transfer of ownership, the obligation to pay common-property management costs passes to the new owner.
What language should we use with residents?
Kyrgyz is the state language of the Kyrgyz Republic and Russian is used as the official language — that is in the Constitution itself. Organisations of every form of ownership that serve consumers provide their services and information in the state language and may repeat them in the official language.
