Two acts, not one: the Housing Code and the ТСЖ law (art. 34; Law No. 122)

Multi-apartment buildings in Kyrgyzstan are governed by two acts: the Housing Code of 9 July 2013 No. 117 (Chapter 4, arts. 31–37, common-property management) and Law No. 122 of 9 July 2013 on owners’ associations, which governs the association itself. The 1997 Law on Homeowners’ Associations is no longer in force; both acts were substantially amended by Law No. 182 of 2023.

Five management forms, self-management capped at four apartments (arts. 31–33)

The Housing Code recognises five ways to run a multi-apartment building; self-management by owners is available only in buildings of no more than four apartments. The form is chosen at the owners’ general meeting by a majority of all owners and binds everyone. Managing a building is not a licensed activity, with no certification or state register of managers. The mechanism that existed until 15 August 2023 was repealed by Law No. 182, and the law provides no replacement.

One member, one vote, and no electronic ballot (arts. 13, 14, 14¹, 14²)

In a Kyrgyz owners’ association each member has one vote, even one who owns several units — the law does not weight votes by floor area. The meeting is valid on more than half of the members; on failed quorum, those present decide by majority what form the next meeting takes. Notice is at least ten days, in writing against signature or by registered post. Absentee voting is a paper ballot signed and stamped by the chairman; the law provides no electronic ballot.

Cashless settlement, enforced by non-payment since 2026 (art. 37; arts. 7, 22)

Owners pay for common-property management in proportion to their share; the rate is set by the general meeting for one year, paid monthly on the charter’s procedure. Since 2023 both an association and a managing organisation must take payments into a bank account and settle cashlessly. From 1 January 2026 owners have had a statutory right to stop paying an association that does not settle cashlessly, and they resume paying when it does.

A 20% penalty cap, debt follows the flat, a court order with no threshold (art. 37.4; art. 6.3)

An association may set a late-payment penalty in its charter, capped by law at twenty per cent of the total debt; a managing organisation has no statutory penalty. Arrears follow the apartment: ownership transfer passes the debt to the new owner. Housing-and-communal arrears are an express ground for a court order with no monetary ceiling, issued within three days without a hearing; a debtor’s objection within ten days cancels it.

No state platform, no register of associations (Law No. 122; Tunduk)

Kyrgyzstan has no state platform for housing management: neither act creates or requires a state information system for meetings, charges, reporting or the building file, and there is no state register of owners’ associations or managing organisations. Tunduk, the country’s interagency data-exchange and e-services infrastructure, does not handle housing.

Questions developers and building managers ask

How should a developer approach smart-building technology in Kyrgyzstan?

Treat it as one platform decision, not a shopping list of hardware: access control, video intercoms, dispatching and a resident app should hand over to the building's management form already connected. The entity that built the building, its founders and its employees may not sit on the association's initiative group or in its founding meeting — in Kyrgyzstan the developer cannot set up the ТСЖ itself.

Do I need a licence to manage a building in Kyrgyzstan?

Managing a multi-apartment building in Kyrgyzstan is not a licensed activity, and there is no certification requirement and no state register of managers.

Does Kyrgyz law let an owners' association vote electronically?

No. Absentee voting is cast on a paper ballot sheet signed by the chairman of the board and stamped, with the results posted on the information board; the law provides no electronic ballot.

What technical and energy obligations does a building have?

Every residential building, whatever its ownership form, must have a house passport recording the in-house networks, the plot boundaries and each owner's share in the common property. Lifts may be serviced only by specialised organisations. Energy certification is mandatory at commissioning, letting, sale and energy renovation; a certificate lasts no more than ten years.

How does a video intercom with phone unlocking work?

The call goes to the resident's phone through the app instead of a panel inside the apartment. The resident sees the visitor on camera and unlocks the door remotely.

What does a smart building cost a developer in Kyrgyzstan, roughly?
