Questions management companies and developers ask
Who manages a jointly owned building in Dubai, the owners or RERA?
In an ordinary Category 3 building, RERA selects and contracts the management company; the owners do not vote on it directly. The owners committee can only request that RERA replace a management entity, not appoint one itself.
What does Mollak require from a management company?
Two RERA-approved bank accounts per property, a general-cash account and a reserve-cash account, all money collected transferred into them, an audited budget approved by RERA, and every service-charge invoice issued through Mollak; an invoice from outside the system is not accepted.
How does a management company recover unpaid service charges?
The management entity holds a lien on the unit, and after a RERA-approved notice and 30 days the claim is enforceable directly before the execution judge at the Rental Disputes Settlement Centre, who may order the unit sold at public auction.
Can the owners committee vote electronically?
Nothing in Law No. (6) of 2019 provides for electronic meetings or electronic voting for the owners committee. Quorum is fixed by attendance, and the management entity must designate a physical place for meetings.
What changed for older buildings under the 2026 building-safety law?
Every building must obtain a Quality and Safety Certificate once 20 years have passed since its completion certificate, and the management entity, not the individual owner, carries that duty for a jointly owned property.
