Copropriété management software for syndics in Côte d’Ivoire

Under Loi n° 2019-576 of 26 June 2019, the Code de la construction et de l’habitat, the general assembly appoints the syndic (the building manager) from the list of syndics approved by the minister in charge of housing. Unitify gives the syndic one place to keep the charges de copropriété (service charges) per lot, record each payment and send reminders, with a resident app for co-owners.

Questions a syndic or syndicat des copropriétaires in Côte d’Ivoire asks

What is the syndicat des copropriétaires?

Under Loi n° 2019-576, all the co-owners of a building divided into apartments, floors or premises are grouped by law (de plein droit) in a syndicat that represents them all (art. 380). The copropriété has three bodies: the assemblée générale (general assembly), the conseil syndical (owners’ council) and the syndic (art. 386).

Does a syndic de copropriété have to be agréé (approved)?

The law provides that the general assembly of the syndicat appoints the syndic from the list of syndics approved by the minister in charge of housing, and that a ministerial arrêté confirms the appointment (art. 396). The conditions for entering the profession of syndic are to be set by regulation (art. 398). Ask the housing ministry whether the list is published and how to apply before you rely on it.

What does the syndic have to do?

Article 395 gives the syndic duties that include acting as secretary of the general assembly, drawing up the budget and keeping the syndicat’s accounts under the control of the conseil syndical, and carrying out the assembly’s decisions. The conseil syndical assists the syndic and checks the management (art. 393).

Who sets the monthly contributions?

The general assembly sets the rate of the co-owners’ monthly contributions (art. 402). Co-owners are bound to pay the monthly charges de copropriété (art. 403). Unitify sends each co-owner the monthly charge in the resident app and keeps the balance of every lot.

What happens when a co-owner does not pay the charges?

Collection is handled either by the syndic or by a collection firm appointed by the general assembly. If charges go unpaid, the syndic sends the defaulting co-owner a reminder letter (lettre de relance); if that fails, the syndic brings an action for forced recovery of the debt (art. 404).

Does the law require a separate bank account?

Yes. The syndic or the conseil syndical must open a separate bank account, a compte bancaire séparé (art. 406). Every co-owner may also consult any accounting document and receipt and ask for any information (art. 390). Unitify does not replace the bank account: owners keep paying as they do today, Unitify records each payment against the right lot and each co-owner receives the charge in the resident app.

What does Unitify do with charges de copropriété?

It keeps a balance per lot, records each payment against the right lot, sends automatic reminders and sends each appel de fonds (call for funds) to the resident app, instead of a month-end reconstruction in a spreadsheet. Residents send requests through the app and the syndic tracks them.

Does Unitify work with Wave, Orange Money or MTN Mobile Money?

There is no integration. Wave, Orange Money and MTN Mobile Money are not connected to Unitify. Owners pay as they do today and Unitify records the payment against the right lot.
