Questions an administrador de comunidad in Chile asks
Which law governs copropiedad inmobiliaria in Chile?
Law 21.442, the new Ley de Copropiedad Inmobiliaria, published in the Diario Oficial on 13 April 2022. It repealed Law 19.537: communities that were under that law follow the new one from its publication, with one year to adjust their reglamentos de copropiedad (art. 100).
Who administers a community and what must they do?
For the administration of the condominio the law lists four bodies: the owners’ assembly, the comité de administración, the administrador and the subadministrador (art. 12). The administrador’s duties include collecting the sums due as economic obligations, issuing certificates of each unit’s debt status and keeping the accounts (art. 20), and giving a documented, detailed account to the committee every month and to the assembly at each ordinary session (art. 21).
Does the administrador have to be on a register?
Yes. The Registro Nacional de Administradores de Condominios is public, mandatory and free, run by the Ministry of Housing and Urban Development, and registration is a prior requirement for acting as administrador or subadministrador, paid or unpaid (arts. 82 and 83). Paid administrators must also show a secondary-school certificate and have passed a training course or hold a labour-competence certification (art. 84).
What must the gastos comunes notice say?
It must state the proportion in which the owner contributes to the gastos comunes and to the fondo común de reserva, with the interest and fines owed to date, and detail total income, monthly expenses and the condominio’s cash balance (art. 31). Notices signed in person or electronically by the administrador have enforcement force (art. 32).
How large must the fondo común de reserva be?
The law requires a fondo común de reserva for extraordinary, urgent or unforeseen common expenses. It is built with a surcharge on the gastos comunes, set by the reglamento de copropiedad or by the assembly in an extraordinary session, which cannot be below 5% of the monthly common expense (art. 39).
Can owners take part in assemblies remotely?
The law allows assembly sessions to be in person, remote or mixed (art. 16), and lets the reglamento de copropiedad provide for virtual participation, with requirements and conditions that ensure effective, simultaneous participation and voting (art. 15).
What does Unitify do with gastos comunes?
It keeps a balance per unit, records each payment against the right unit, sends automatic reminders and sends the charge to the resident app, instead of reconstructing the accounts at month end.
Does Unitify integrate with Webpay or Khipu?
There is no integration with Webpay or Khipu. Owners pay as they do today and Unitify records the payment against the right unit.
