Service Charge Statements in a Czech SVJ: Deadlines and Contents

A Czech SVJ (společenství vlastníků jednotek, the owners' association) must deliver the service charge statement (vyúčtování služeb) to each unit owner within 4 months after the settlement period ends – 30 April for a calendar year. Over- and underpayments are settled by the agreed date, at the latest within 4 months of delivery. The owner has 30 days from delivery to ask for documents or object. The rules are in Act No. 67/2013 Sb. on services in buildings with flats (zákon č. 67/2013 Sb.) and the Civil Code (občanský zákoník, zákon č. 89/2012 Sb., OZ). The quotations below are the Czech text of the law.

What are advances for services?

The owner's regular payments for services, settled once per settlement period; the owner has the right to a timely statement:

„Vlastník jednotky platí zálohy na plnění spojená nebo související s užíváním bytu (služby) a má právo, aby mu osoba odpovědná za správu domu zálohy včas vyúčtovala.“ (OZ § 1181)

The owners' meeting (shromáždění) approves the types of services and how their cost is split between units (OZ § 1208(d)). For that agenda item, use our Czech templates: notice of meeting, minutes and, where the statutes (stanovy) allow it, written vote per rollam.

The SVJ may change the monthly advance during the year to match a price change or for another justified reason. The notice decides:

„Změněná měsíční záloha může být požadována nejdříve od prvního dne měsíce následujícího po doručení písemného oznámení nové výše zálohy. Změna výše měsíční zálohy musí být v oznámení řádně odůvodněna, jinak ke zvýšení zálohy nedojde.“ (Act 67/2013 Sb. § 4(4))

The new advance applies at the earliest from the month after written notice is delivered; without proper reasons, the increase does not take effect.

How long is the settlement period?

At most 12 months. The provider of services – for unit owners, the SVJ – sets when it starts.

„zúčtovacím obdobím období, za které poskytovatel služeb provede rozúčtování a následné vyúčtování nákladů; zúčtovací období je nejvýše dvanáctiměsíční a jeho počátek určí poskytovatel služeb“ (Act 67/2013 Sb. § 2(1)(c))

What is the deadline for the service charge statement?

At the latest 4 months after the settlement period ends.

„Není-li jiným právním předpisem stanoveno jinak, skutečnou výši nákladů a záloh za jednotlivé služby vyúčtuje poskytovatel služeb příjemci služeb vždy za zúčtovací období a vyúčtování doručí příjemci služeb nejpozději do 4 měsíců od skončení zúčtovacího období.“ (Act 67/2013 Sb. § 7(1))

A party that misses a duty under the Act – for example an SVJ that delivers the statement late – owes the other party a penalty (Act 67/2013 Sb. § 13(1)). The SVJ sets the amount, at most CZK 50 for each day begun. Without a decision it is CZK 50 a day:

„Nedojde-li k ujednání s nájemci nebo rozhodnutí družstva anebo společenství, činí výše pokuty 50 Kč za každý započatý den prodlení.“ (Act 67/2013 Sb. § 13(2))

What must the statement contain?

The actual costs by service and the advances received, so the difference can be checked.

„Poskytovatel služeb ve vyúčtování musí uvést skutečnou výši nákladů na služby v členění podle poskytovaných služeb se všemi potřebnými náležitostmi, včetně uvedení celkové výše přijatých měsíčních záloh za služby tak, aby výše případných rozdílů ve vyúčtování byla zřejmá a kontrolovatelná z hlediska způsobů a pravidel sjednaných pro rozúčtování.“ (Act 67/2013 Sb. § 7(2))

The cost of preparing and delivering the statement cannot be charged as a service cost:

„Náklady na vyhotovení a doručení vyúčtování podle odstavce 1 nelze zahrnout do nákladů na služby.“ (Act 67/2013 Sb. § 7(4))

When is the balance due?

By the agreed date, at the latest 4 months after delivery.

„Finanční vyrovnání provedou poskytovatel a příjemce služeb v dohodnuté lhůtě, nejpozději však ve lhůtě 4 měsíců ode dne doručení vyúčtování příjemci služeb. Vady vyúčtování neovlivňují splatnost přeplatku. Splatnost nedoplatku neovlivňují takové vady vyúčtování, které nemají vliv na vypočtenou výši nedoplatku.“ (Act 67/2013 Sb. § 7(3))

Defects do not delay a refund, and an underpayment stays due if a defect does not change its amount.

How does an owner object to the statement?

In writing, within 30 days. First the owner may ask for the supporting documents:

„Do 30 dnů od doručení vyúčtování může příjemce služeb písemně požádat poskytovatele služeb, aby příjemci služeb doložil náklady na jednotlivé služby, způsob jejich rozúčtování, způsob stanovení výše záloh za služby a provedení vyúčtování podle tohoto zákona a aby umožnil příjemci služeb pořízení kopie podkladů. Této žádosti poskytovatel služeb vyhoví do 30 dnů od jejího doručení.“ (Act 67/2013 Sb. § 8(1))

The SVJ has 30 days to provide them. Then the objections:

„Případné námitky ke způsobu a obsahu vyúčtování předloží příjemce služeb poskytovateli služeb do 30 dnů od doručení vyúčtování, popřípadě doložení podkladů podle odstavce 1. Nepředloží-li příjemce služeb námitky v této lhůtě, platí, že se způsobem a obsahem vyúčtování souhlasí. Včas uplatněné námitky musí poskytovatel služeb vyřídit do 30 dnů od jejich předložení.“ (Act 67/2013 Sb. § 8(2))

Miss the 30 days and the statement counts as accepted. The SVJ answers timely objections within 30 days.

Example: the deadlines for 2025

  • Settlement period: 1 January – 31 December 2025.
  • Statement delivered: by 30 April 2026 at the latest.
  • Delivered 31 March 2026: documents may be requested and objections raised by 30 April 2026 (after a request, the objection period runs from when the documents are provided).
  • Settlement of the balance: by the agreed date, at the latest 31 July 2026.

Check with a lawyer how deadlines are counted in your case. The quoted deadlines are unchanged in the version of the Act in force from 1 January 2027.

What happens to the statement when a unit is sold?

The SVJ has no duty to settle contributions and advances at the moment of transfer (OZ § 1186(1)). The seller's debts can pass to the buyer:

„Při převodu vlastnického práva k jednotce přecházejí s jednotkou na nabyvatele dluhy převodce vůči osobě odpovědné za správu domu na příspěvcích na správu domu a pozemku a na plněních spojených nebo souvisejících s užíváním bytu a zálohách na tato plnění, měl-li je a mohl-li je nabyvatel zjistit.“ (OZ § 1186(2))

Debts for contributions, services and advances pass if the buyer knew or could have found out; the seller remains liable. The seller proves them with a confirmation from the SVJ:

„Převádí-li vlastník vlastnické právo k jednotce, doloží nabyvateli potvrzením osoby odpovědné za správu domu, jaké má dluhy podle odstavce 2, popřípadě že takové dluhy nejsou; potvrzení vydá nabyvateli se souhlasem převodce také osoba odpovědná za správu domu.“ (OZ § 1186(3))

If the confirmation does not show the debts, or the SVJ did not issue it without undue delay, the buyer is presumed unable to have known. The SVJ acts through its committee (výbor) or chair (předseda); see our article on the committee.

What Unitify does

The SVJ prepares and delivers the statement. Unitify helps with the work around it:

  • Charges and debts. Advances, payments and arrears are kept per apartment, with reminders.
  • Notices. Notices to owners, such as a new advance amount, go out in the resident app; the manager chooses the text and the language. Whether such a notice meets the written form is for the association's lawyer.
  • Documents. Statements, supporting documents and minutes can be stored per building and published to owners.

The app's interface is in English for now and is set up for each project; there is no Czech interface yet.

Frequently asked questions

By when must an SVJ deliver the service charge statement?

Within 4 months after the settlement period ends. For a calendar-year period the last day is 30 April. The settlement period is at most 12 months and its start is set by the provider of services, which for unit owners is the SVJ (Act 67/2013 Sb. § 2(1)(c), § 7(1)).

What must the service charge statement contain?

The actual costs broken down by service and the total monthly advances received, so that any difference is clear and can be checked. The cost of preparing and delivering the statement cannot be charged as a service cost (Act 67/2013 Sb. § 7(2) and (4)).

When is the balance due?

Overpayments and underpayments are settled by the agreed date, at the latest within 4 months of delivery of the statement. Defects do not delay a refund. Defects that do not affect the calculated amount of an underpayment do not delay its due date either (Act 67/2013 Sb. § 7(3)).

How does an owner object to the service charge statement?

Within 30 days of delivery the owner may ask in writing for the supporting documents; the SVJ has 30 days to comply. Objections are due within 30 days of delivery, or of receiving the documents. Without them the statement counts as accepted. The SVJ must deal with timely objections within 30 days (Act 67/2013 Sb. § 8(1)–(2)).

What are advances for services, and can the SVJ change them mid-year?

They are the owner's regular payments for services connected with the use of the flat, and the owner has the right to have them settled on time (OZ § 1181). The monthly advance may change during the year to match a price change or for another justified reason, at the earliest from the first day of the month after a written notice with reasons is delivered (Act 67/2013 Sb. § 4(4)).

What happens to the service charge statement when a unit is sold?

The SVJ has no duty to settle advances at the moment of transfer (OZ § 1186(1)). The seller's debts for advances and services pass to the buyer if the buyer knew or could have found out about them, and the seller remains liable. The seller proves them with a confirmation from the SVJ (OZ § 1186(2)–(3)).
