Software for joint-housing management committees in Nepal
Under Nepal’s Ownership of Joint Housing Act, 2054 (1997), apartment owners pay collective expenses in the proportion their agreement sets, and once the promoter has sold every apartment they can form a housing management committee that takes over the promoter’s duties. Unitify gives that committee a running balance per apartment, reminders and a resident app.

Questions from joint-housing committees and apartment owners in Nepal
Who looks after a sanyukta awas (joint housing) building — the promoter or the owners?
The Ownership of Joint Housing Act, 2054 (1997) first puts the protection, care, repair and maintenance of the buildings and collective areas on the promoter (s. 23). The apartment owners form a housing management committee from among themselves when the promoter has sold all its apartments, when all owners agree in writing to run the building themselves and ask the promoter, or when the promoter is dissolved or insolvent; the committee then performs the promoter’s functions and fixes its own meeting procedure (s. 24). This page follows the Nepal Law Commission’s English translation; the Nepali text is the authoritative one, so check it with a local adviser.
How are collective expenses split between apartments?
Each owner pays the promoter or the committee the cost of operating, maintaining, upkeeping and cleaning the collective areas and facilities, proportionately as the agreement stipulates (s. 18). That is why the sale agreement must state the collective expenses and maintenance liabilities and the percentage of the area each apartment occupies (s. 15(2)). The promoter or committee raises its charges and fees as fixed in the agreement (s. 25).
Can an owner refuse to pay the maintenance charge?
No. The Act says an apartment owner has no right to refuse payment of collective expenses stipulated in the agreement (s. 19). Until the amount is paid, the promoter or committee may withhold that owner’s use of collective and restricted collective areas and facilities, or suspend the transfer of the apartment (s. 20). Take local advice before you withhold anything.
Can I sell my apartment while charges are still outstanding?
Not until they are cleared. The office that registers deeds will not register the sale until the promoter or the committee states in writing that no amount, charge or fee is outstanding (s. 13), and the promoter or committee gives that written consent when nothing is owed (s. 14). Where an amount is still owed on an apartment’s purchase, its ownership cannot be transferred until that amount is paid (s. 12(2)).
Does the building have to be insured?
Yes. Insuring the joint housing against natural calamities is mandatory for the promoter or the committee, and the owners bear the premium proportionately as the agreement stipulates (s. 21). If the building is partly damaged but repairable, the promoter or the committee repairs it within the prescribed period (s. 22(2)).
Can the committee make its own house rules?
Yes, within the Act and its rules. The promoter or committee may make working procedures on protection, repair and maintenance, on what owners must follow when using the building, and on the terms of staff working there (s. 36). The competent authority may also issue directives for the proper operation of a joint housing, which the promoter or committee must follow (s. 33).
What does Unitify keep for a housing management committee?
A running balance for every apartment, with each payment recorded against the apartment it belongs to, so the committee can see at a glance whether anything is outstanding before it signs a consent to sell. Unitify sends automatic reminders, puts each month’s charge in the owner’s resident app, and keeps notices and repair requests from residents in one log until they are closed.
Do we need a particular bank or wallet app to pay through Unitify?
No. There is no integration with a bank or a wallet app; owners pay as they do today and Unitify records the payment against the right apartment. Paying online by card inside the resident app needs a payment provider connected for your buildings; we agree it per project.
