Under Decree 352/GOV on Condominiums, in force since 1 February 2024, the licensed operator must hold the first owners’ meeting within six months of selling more than 30 per cent of the units, and owners share management costs by their ownership ratio. Decree 352 in practice: questions from Lao condominiums
Who manages a condominium in Vientiane under Decree 352?
In the decree, the condominium juristic person is the operator licensed to run the condominium business, and it writes the condominium regulations (art. 3). The building’s manager is either that juristic person itself or a company the developer hires, with the agreement of the owners’ meeting (art. 26). The operator’s side runs the building day to day, and owners oversee it through their meeting and committee.
When must the first owners’ meeting take place?
The condominium juristic person must hold the first ordinary meeting of unit owners within six months after more than 30 per cent of all units in the condominium have been sold (art. 30). For a developer, that sales threshold is the date to have the owners’ list and their balances ready.
How often do owners meet, and how are votes counted?
At least once a year, and at any time when there is a need or an emergency. A meeting can open only if at least two-thirds of all unit owners attend, and an owner may send someone else with a written proxy (art. 30). Resolutions pass by a majority of the owners present, an owner of several units votes once per unit, and voting may be open or secret (art. 31).
What does the condominium committee do?
The owners’ meeting elects the committee responsible for the condominium (ຄະນະກຳມະການຮັບຜິດຊອບຄອນໂດມິນຽມ) from among the unit owners, with at least three members and always an odd number (art. 28). It follows the manager’s work regularly and calls the owners’ meeting, preparing its content and agenda (art. 29(5) and (6)).
What must the manager bring to the owners’ meeting?
A plan and a budget for managing the condominium, prepared for the owners’ meeting to consider, and a summary report of the manager’s own work to both the owners’ meeting and the committee (art. 27(3) and (10)).
How are management costs divided between unit owners?
Owners share the costs of managing the jointly owned parts and the services set in the condominium regulations, such as building insurance, security, cleaning and upkeep of shared equipment, in proportion to their unit ownership (art. 32). The condominium juristic person carries management costs as the condominium regulations set them (art. 38(5)).
What does Unitify do for a Lao condominium manager?
It keeps a running account for each unit: its share of the management costs, every payment recorded against it and what is still due. Reminders go out automatically, owners see their charges and send requests in the resident app, and the per-unit figures are in one place when the budget and the yearly report go to the owners’ meeting.
Can owners pay through a Lao bank app inside Unitify?
No. There is no integration with any Lao bank or payment app. Owners pay as they do today, for example by bank transfer, and Unitify records each payment against the right unit. Paying online by card in the resident app needs a payment provider connected for your buildings; we agree it per project.
