SZMSZ of a Hungarian Társasház: Mandatory, Contents, Who Adopts It

A Hungarian társasház must set its bodies, their powers and the rules of bearing the common cost in its organisational and operating rules, the SZMSZ (szervezeti-működési szabályzat). It is adopted at the founding meeting, or at the latest at a meeting within sixty days after it, by a simple majority of the total ownership shares, and submitted to the property authority within 15 days. This is Act No. CXXXIII of 2003 on társasházak (Tht.). The quotations are the Hungarian text of the Act. We give no sample: the Act prescribes contents, not wording.

Is an SZMSZ mandatory?

„A közösség szerveit, azok hatáskörét, jogait és kötelezettségeit, a közös költség viselésének szabályait a közösség szervezeti-működési szabályzatában kell megállapítani.” (Tht. § 13(1))

The "kell" (must) is plain: the SZMSZ is the house's basic document on its bodies and the common cost. Small buildings have an exception:

(Tht. § 13(3))

At up to six apartments it is for the community to opt into the Act's organisational rules; above that, the SZMSZ rules apply.

What must it contain?

„A szervezeti-működési szabályzatnak – e törvény keretei között – tartalmaznia kell:” (Tht. § 13(2))

Six items, each requiring detailed rules:

„a) a tulajdonostárs külön tulajdonának használatára, hasznosítására, a külön tulajdonon belül nem mérhető közüzemi és más szolgáltatások díjának elszámolására és megfizetésére,” (Tht. § 13(2)(a))

„b) a közös tulajdon fenntartására, ezen belül – a közös költség viselésére és a költség-hátralékok megfizetésére, – felújítási alap képzése esetén az alap felhasználására,“ (Tht. § 13(2)(b))

„c) a társasházi lakóépület házirendjére, d) a közgyűlés, illetőleg a részközgyűlés hatáskörére és eljárására, e) a közös képviselő vagy az intézőbizottság elnöke és tagjai hatáskörére és feladataira, f) a számvizsgáló bizottság, ennek hiányában a közösség ellenőrzési jogkörére, feladataira vonatkozó részletes szabályokat.” (Tht. § 13(2)(c)–(f))

As a checklist: (a) use of the separately owned unit and settlement of services that cannot be metered inside it; (b) upkeep of the common property, including bearing the common cost, paying cost arrears and, where a renovation fund is formed, the use of that fund; (c) house rules; (d) powers and procedure of the general meeting; (e) powers and tasks of the közös képviselő or intézőbizottság; (f) the audit committee, or the community's control powers if there is none.

What about the renovation fund?

The query "how big must the renovation fund be?" often implies the law sets a minimum. The Act text we read does not. The rule is conditional: "felújítási alap képzése esetén" (where such a fund is formed) the SZMSZ must regulate how it is used. So if the community forms a fund, the SZMSZ says what it may be spent on. Whether to form one, and how large, the quoted text does not decide.

Who adopts it, and how?

„A szervezeti-működési szabályzatot a közösség az alakuló közgyűlésen – de legkésőbb az azt követő hatvan napon belül megtartott közgyűlésen – az összes tulajdoni hányad szerinti legalább egyszerű szavazattöbbségű határozatával állapítja meg.” (Tht. § 14(1))

"Az összes tulajdoni hányad szerinti" means the total of the ownership shares counts, not just those present. It can be amended at any time in the same way:

„A közösség – a 14. §-ban meghatározottak szerint – a szervezeti-működési szabályzatot bármikor módosíthatja. A szervezeti-működési szabályzatot, illetve annak módosítását a közösség 15 napon belül az ingatlanügyi hatóságnak annak okirattárba helyezése céljából benyújtja.” (Tht. § 15)

That also answers "where is the SZMSZ kept": it is submitted to the property authority for its document archive. How to inspect it there is not in the quoted text.

Online meetings and written voting

The SZMSZ decides whether owners may take part by electronic means:

„A közgyűlésen a tulajdonostárs a jogait személyes megjelenés helyett elektronikus hírközlő eszközök igénybevételével akkor gyakorolhatja, ha a szervezeti-működési szabályzat az igénybe vehető elektronikus hírközlő eszközöket, valamint azok alkalmazásának feltételeit és módját úgy határozza meg, hogy a résztvevők azonosítása, és a résztvevők közötti kölcsönös és korlátozásmentes kommunikáció biztosított legyen.” (Tht. § 38(4))

So online attendance cannot be switched on by a simple decision: the SZMSZ must first set the means, conditions and manner, with identification and mutual communication ensured. The details of written voting belong in the SZMSZ too:

„Az írásbeli szavazásnak és az eredmény megállapításának részletes szabályait a szervezeti-működési szabályzatban kell meghatározni.” (Tht. § 40(2))

What an owner can ask

Whether the house has an SZMSZ, when it was adopted and whether it was submitted to the property authority; what it says on bearing the common cost and arrears; what it says on the renovation fund; and whether it allows online attendance and how it regulates written voting.

What Unitify does

The community and its közös képviselő draw up and adopt the SZMSZ; Unitify writes no rules. It helps with the daily operation the rules describe: common cost and arrears per apartment, resolutions and minutes stored per building and shareable with owners, and notices to owners in the resident app. Whether a vote cast in the app meets the Act and the SZMSZ is for the community's legal representative. The app interface is in English for now and is set up for each project; there is no Hungarian interface yet.

If you are a közös képviselő, you can start free from the Unitify page for Hungary. If you are an owner, ask the képviselő the questions above; the report deadline is in our article on the annual accounts.

Frequently asked questions

Does a társasház have to have an SZMSZ?

Yes. The community's bodies, their powers, rights and duties and the rules of bearing the common cost must be set in the SZMSZ (Tht. § 13(1)). A community of at most six apartments may decide to apply the Act's organisational rules; if it does not, the Civil Code's rules on co-ownership apply (Tht. § 13(3)).

What must the SZMSZ contain?

Within the Act, detailed rules on the use of the separately owned unit, the maintenance of the common property and the common cost, the house rules, the powers and procedure of the general meeting, the powers and tasks of the közös képviselő, and the tasks of the audit committee (Tht. § 13(2)(a)–(f)).

Who adopts the SZMSZ and where is it filed?

The community, at the founding meeting or at the latest at a meeting within sixty days after it, by a simple majority of the total ownership shares. The SZMSZ or an amendment is submitted to the property authority within 15 days (Tht. § 14(1), § 15).

Is a renovation fund mandatory, and how big must it be?

Among the detailed rules on the upkeep of the common property the SZMSZ must regulate, in the Act's words, "felújítási alap képzése esetén az alap felhasználására" (where a renovation fund is formed, the use of the fund), so forming it is conditional. The Act text we read sets no minimum amount (Tht. § 13(2)(b)).
